- Solving the financial crisis in an Honours Class?
- From March till June 2009 the Honours Class: Comparative and International Insolvency Law will be held at University of Leiden Law School. Keeping the current financial crisis in sight it is evident that the subject is influencing businesses, banks and private individuals all over the world. Starting with a preparatory seminar in March 2009, the Honour Class will be continued with ten seminars of three hours, dealing with three themes. The first theme relates to the question: which court in the world has jurisdiction to open insolvency proceedings? The treatment is very practical, based on such cases as Parmalat / Eurofood, MG Rover Car Company, Eurotunnel and the Cayman registered hedge funds of Bear Stearns. Which law is applicable to these insolvency proceedings? That is the second topic to be addressed: rules relating to the position of secured or unsecured creditors or the termination of employment contracts will be dealt with. The third theme concerns the way insolvency office holders and courts in different states communicate and cooperate to solve complex cross-border reorganisations. Here again, many practical examples will be addressed. The faculty consists of several renowned law professors and practitioners in the field of international insolvency law from the USA, Canada, England and Germany.
- The target group is advanced bachelor students, preferably those who have participated in the elective course Insolventierecht (Insolvency Law, taught in Dutch) and who are highly motivated to explore the most topical issues of insolvency law in a globalising world. Also non-Dutch students living outside the Netherlands will be invited to apply.
- The most ideal honour class would be composed of 8 to 12 students. For those who are interested: the application deadline is 19 December 2008. To apply, one requires to write a letter explaining interest and motivation to participate, as well as a short resume and preferably a recommendation. Selected students will be invited for an interview. For those interested professor Wessels will chair an open information hour on Thursday 4 December at 17.00 hours, class room to be advised.
